Leonard Leo

Leonard Leo is arguably the most consequential political operative in modern American history — not because he holds office, and not because he has the most money, but because he figured out something no one else did: the most efficient way to reshape American society is through the courts. And then he did it. Born in 1965 in Monroe, New Jersey, Leo attended Cornell and Georgetown Law. He joined the Federalist Society — then a small conservative legal organization — and slowly rose to become its executive vice president, the position from which he would transform American law. Leo understood that while elections come and go, federal judges serve for life. A single well-placed judge can reshape policy for generations. Over the past two decades, Leo personally advised on the selection of all six conservative Supreme Court justices currently serving. He was Trump's primary judicial advisor, providing the famous list of potential Supreme Court nominees that Trump campaigned on in 2016. When vacancies arose, Leo's recommendations were decisive: Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett were all Leo selections. The Judicial Crisis Network, which Leo effectively controls, spent millions on confirmation campaigns for each. The results have been staggering: the overturning of Roe v. Wade (Dobbs v. Jackson), the expansion of gun rights (Bruen), the curtailment of EPA authority (West Virginia v. EPA), the end of affirmative action in college admissions (Students for Fair Admissions v. Harvard), and the reversal of Chevron deference (Loper Bright v. Raimondo). Each of these decisions was made possible by justices Leo selected and confirmed. In 2021, Leo's operation received the largest dark money donation in American history: $1.6 billion from Barre Seid, an electronics magnate who donated his entire company (Tripp Lite) to Leo's Marble Freedom Trust, a 501(c)(4) that doesn't disclose its donors. This single donation gave Leo more political capital than many national parties. But Leo's operation has also made Leo personally wealthy. Through CRC Advisors, a consulting firm he co-founded, Leo has collected tens of millions in fees from the very nonprofits he controls. Senate investigators found that Leo-affiliated nonprofits funneled approximately $35 million to CRC Advisors and $15 million to BH Group, a company Leo partly owns. The DC attorney general has investigated whether Leo misused nonprofit funds for personal enrichment. Leo's network is a maze of interlocking organizations — the Federalist Society, Judicial Crisis Network, 85 Fund, Concord Fund, Rule of Law Trust, Marble Freedom Trust, and dozens more — that pass money between each other in ways that are nearly impossible to trace. It is the most sophisticated dark money operation in American politics. The irony: Leo, who has done more than anyone to shape the American judiciary, has never been elected to anything. He has never been confirmed by the Senate. He has never been subject to democratic accountability. He is an unelected man who has reshaped the rights of 330 million Americans through the strategic deployment of dark money and personal access.
